A Minor Issue

Generally speaking, minors do not have the capacity to enter into contracts, so any leases that they sign would be voidable (and therefore, not worth much to you or your client). Additionally, the parents will not be able to sign on the child’s behalf, as the interest belongs to the child and not the parents. In this situation, a guardian representing the child’s interest will need to be appointed by the court prior to executing any transactions. That process will differ from state to state, but the main thing for you to remember is that the guardian is the person that must sign the lease.
